Working to change the law

To the Editor:

Currently, Florida law does not include provisions that allow for any type of driver license for a person with a permanent DUI revocation. A change in law would be required for the department to consider reinstatement. Sen. Bill Nelson’s office has been notified as to these circumstances and suggested that a petition be written up and signed by citizens of the state of Florida to bring to his attention the importance of more adequate legislation regarding these circumstances.

In addition to the previous facts listed in this petition, allow me to present additional information for your consideration.

This petitioner has abstained from any alcohol or other drugs since his last conviction nearly 10 years ago, has successfully completed treatment on every occasion and in spite of his limited options in transportation, has demonstrated good character and work history in his attitude, quality of work, attendance, skills, initiative, cooperation and reliability.

Working for new legislation would be similar to what is listed in the CFR 46 part 10.201 (h)(4),(i) and (j) in that; ruling authority will consider the appliacants’ evidence and many issue the license; in less than the listed minimum assessment period for his or her conviction has elapsed; may consider the following factors, as applicable in assessing the applicants suitability to hold a license. This list is intended as a guide; may consider other factors which he or she judges appropriate to a particular applicant, such as:

1. Proof of completion of an accredited alcohol or drug abuse rehabilitation program.

2. Active membership in a rehabilitation or counseling group, such as Alcoholics Anonymous or Narcotics Anonymous.

3. Character references from person who can attest to the applicants’ sobriety, reliability and suitability for employment in the merchant marine.

4. Steady employment.

5. Successful completion of all conditions of parole or probations.

This applicant attests that all of the above mentioned criteria has been met.

If the readers of this petition find that the information contained here is apt and suitable to the stated circumstances and should be submitted to the appropriate legislative body for their consideration, please sign my petition and contact your legislative representative and encourage them to act with due diligence quickly and enact new legislation “in order to form a more perfect union.”
