Motorcyclist facing numerous charges following accident
A motorcyclist was in jail Tuesday and his passenger remained hospitalized after they drove into the back of a vehicle operated by a Cape Coral man.
Michael Giovanni Agosto, 29, of Homestead, was arrested and charged Sunday with DUI unlawful blood alcohol, DUI unlawful blood alcohol serious bodily injury to another and knowingly drive while license suspended revoked, along with two counts of DUI unlawful blood alcohol damage property.
He is being held at the Lee County Jail on $77,000 bond, according to booking records.
At 3:21 a.m. Sunday, Agosto was driving a 2003 Honda north on U.S. 41 when he collided into the rear of a Honda Civic also traveling north, just south of Airport Road. The Florida Highway Patrol reported that the Civic was stopped for traffic and Agosto failed to slow down to avoid the collision.
Due to the impact, Agosto and his passenger, Carlos Montalban, 32, were ejected.
Montalban, of Delray Beach, sustained critical injuries in the accident and was transported to Lee Memorial Hospital. As of Tuesday, he was listed in critical condition, according to officials.
Montalban apparently was not wearing a helmet during the crash, but Agosto was.
Agosto sustained minor injuries in the accident and was also transported to Lee Memorial Hospital. After being treated and released, he was taken into custody by the FHP and booked at the jail.
The driver of the Civic, Policarpo Rangel, 55, of the Cape, was not injured in the crash, officials reported. Two passengers in Rangel’s vehicle, also Cape residents, were not injured either.
Agosto has a court appearance scheduled for May 5.
