Police: DNA leads to arrest of Cape man in sexual assault on teen
A Cape Coral man was charged with sexual assault Tuesday after his DNA allegedly matched DNA evidence collected from the 19-year-old victim.
Albert Lewis Black Jr., 38, of 3602 N.E. 19th Ave., was booked at the Lee County Jail on sexual assault victim 12 years of age older special conditions, kidnap inflict bodily harm or terrorize and burglary with assault or battery.
As of Wednesday, he was being held without bond for violating probation.
On May 1, the Fort Myers police responded to a sexual battery. A woman stated that she awoke to a man lying on top of her, according to an arrest report. He reportedly told the victim not to move, threatening to kill her.
The woman tried to get away, but the man kept her pinned and sexually battered her. The man then fled from the central Fort Myers home.
The victim completed a sexual assault kit, and the evidence collected was sent to the Florida Department of Law Enforcement’s crime lab for testing. On Thursday, detectives were notified the DNA collected matched Black’s.
He was on probation.
According to the Florida Department of Corrections, Black was released from prison in October 2010 after being found guilty in May 2000 on:
* Three counts of armed robbery with firearm or deadly weapon
* Three counts of first-degree burglary while armed
* Two counts of robbery with no weapon
* Two counts of attempted kidnapping
* One count of robbery with weapon
* One count of attempted armed robbery with firearm or deadly weapon
He had been sentenced to serve 14 years for the convictions.
On Friday, Black’s probation officer instructed him to come in. Fort Myers police took Black into custody and transported him to the headquarters.
According to the report, he provided detectives with a statement.
He was arrested and charged, then transported to the Lee County Jail.
“DNA is irrefutable evidence,” Fort Myers Police Chief Doug Baker said in a prepared statement Wednesday. “I am relieved that we caught the suspect and (am) extremely proud of the investigative work by everyone involved.”
Black has a court appearance scheduled for Sept. 4.
