17-year-old Cape resident charged with sexual assault
A 17-year-old Cape Coral boy is accused of having sex with an 11-year-old girl in the bathroom of a church over the weekend.
Pierre Edval Tony, of 1711 S.E. 15th Terrace, was arrested and charged Sunday with sexual assault by person under 18 years of age, sexual battery victim under 12 years of age. He was booked at the Charlotte County Jail.
Tony has since been released to the Department of Juvenile Justice.
He could not be reached for comment Tuesday. A man who answered his home phone identified himself as Tony’s father but declined to comment.
According to the arrest report, the Charlotte County Sheriff’s Office received a call on Sunday from the Peace River Regional Medical Center in Port Charlotte. The girl’s mother had brought her in for an evaluation.
The mother reported that she was leaving the 7th Day Adventist Church, located in Port Charlotte, at about 9 p.m. Saturday when she could not find her daughter. Ten minutes later, the girl exited the church “distraught.”
When they arrived home, the girl told her mother that she had had consensual sex with Tony in the church bathroom, the report states.
During an interview with detectives, the girl reportedly stated that she kissed Tony and he asked if she wanted to have sex. She stated that she “agreed to have sexual intercourse” with Tony, her friend, and they did.
Tony and his father, Schubert Tony, reportedly voluntarily came to the Mid County Sheriff’s Office for an interview. They were aware of the situation and the allegations being made, according to the report. Tony gave a statement.
He was taken into custody and transported to the Charlotte jail.
