Cape Coral man pleads guilty to fraud, identity theft

A Cape Coral man has pleaded guilty to federal charges brought against him in December.

Middle District of Florida U.S. Attorney A. Lee Bentley III reported that Henry Alberto Fernandez Gomez, 30, pleaded guilty on April 25 to access device credit card fraud and aggravated identity theft.

He faces a maximum penalty of 10 years in federal prison for the fraud charge and a mandatory minimum term of two years for the identity theft charge; the sentences will be served consecutively.

A sentencing date had not yet been set as of last week.

According to a plea agreement, Gomez used stolen and unauthorized credit card information to make 27 purchases at retail establishments throughout Florida between December 2014 and April 2015. On one occasion, Gomez used the stolen credit card information to buy furniture for approximately $3,500.

Gomez also used another person’s means of identification to make a purchase at a liquor store.

The case was investigated by the Federal Bureau of Investigation, Lee County Sheriff’s Office’s Economic Crimes Unit and Cape Coral Police Department.
