Cape police charge man with child neglect

A man is accused of child neglect and DUI after Cape Coral police found him “passed out” behind the wheel of a vehicle, according to an arrest report.
Michael Joseph Cutillo, 38, of 1631 Red Cedar Drive, Apt. 1, Fort Myers, was arrested and charged Sunday morning with one count of DUI and one count of child neglect without great harm. He was released Monday on pretrial release supervision and he has a court date Aug. 9, according to jail booking records.
A telephone message left Tuesday for Cutillo was not returned.
According to the report, a police officer was flagged down at about 1 a.m. by a convenience store clerk in the 700 block of Del Prado Boulevard. The clerk pointed to a running vehicle parked in the parking lot with its lights on. He had been told by customers that Cutillo was “passed out behind the wheel.”
The clerk told the officer that Cutillo had been in the area for about 60 minutes. Several bystanders stated that they were knocking on the window but they received no response from Cutillo. The officer found Cutillo seated behind the wheel with “his head down,” the report states.
The officer knocked on the window and door several times with no response. According to the report, a small child in the rear passenger seat also did not not respond to the knocking. The officer opened the door and Cutillo woke up asking if anything was wrong. The officer asked him to step out of the car.
Cutillo reportedly stumbled out of the vehicle, had trouble standing upright and would sway back and forth while standing in place. The officer conducted field sobriety tests on Cutillo then placed him under arrest. Cutillo completed a breath test and blew .000. A urine test was taken with the results pending.
According to the report, Cutillo told the officer that he is on disability and admitted to taking Prozac and Xanax. The child was turned over to a relative and the Department of Children and Families was notified about the incident.
