Cape man charged with DUI manslaughter
A Cape Coral man has been charged with DUI manslaughter in a single-car crash in 2009 that left a passenger dead.
Andrew W. Curl, 27, of 1008 NE 9 St., was charged with DUI manslaughter in the death of Shawn Hough, 27, of 1928 SE 1 Terrace. Hough died Aug. 19, 2009. after he was ejected from the vehicle Curl was driving on Santa Barbara Boulevard.
The traffic crash occurred at 10:52 p.m. in the 1300 block of Santa Barbara Boulevard South. During the investigation, it was determined that Curl was traveling north on Santa Barbara Boulevard after leaving Hustler’s Pool Hall. Officials say he was traveling at a high rate of speed when the vehicle drifted to the right and struck the curb. Curl, who was wearing a seatbelt, overcorrected back to the left causing his car to spin counterclockwise. The vehicle crossed over the median and the southbound lanes of travel before entering the front yard of 1236 Santa Barbara Boulevard South. The vehicle then rolled over toward the passenger side. During the violent roll, the front passenger, Hough, who was not wearing a seatbelt, was ejected from the vehicle and was thrown in front of the building. The vehicle continued to roll, struck the building, and landed on top of Hough.
Hough died at Lee Memorial Hospital from his injuries.
A mandatory blood draw was performed with FDLE toxicology results showing that Curl had a blood alcohol content of 0.240 and 0.238, officials said. In Florida, a driver is considered impair with a level of .08 or greater.
